Collective redress legislation in the Czech Republic and within the European Union

This diploma thesis deals with the analysis of the material intent of the collective proceedings bill in the Czech Republic, the implementation of collective redress in the European Union on account of the approval of a new directive on representative actions as well as the already established legislation in four member states (France, Italy, the Netherlands and Sweden). The aim of this thesis is to evaluate the compatibility of the collective proceedings bill in the Czech Republic with the intent of the European Union and present the results of comparison of individual legislations in the above-mentioned EU member states. One chapter is solely dedicated to the international jurisdiction of the court regarding collective redress with a cross-border implication.Tato diplomová práce se zabývá analýzou věcného záměru zákona o hromadném řízení v České republice, zavedením hromadných žalob v Evropské unii z důvodu schválení nové směrnice o zástupných žalobách i již etablovanou právní úpravou ve čtyřech členských státech Evropské unie (jedná se o Francii, Itálii, Nizozemsko a Švédsko). Cílem práce je posoudit slučitelnost věcného záměru zákona, kterým se upravují hromadné žaloby v ČR se záměrem Evropské unie a představit výsledky komparace právních úprav vybraných členských států EU. Jedna kapitola je věnována i mezinárodní příslušnosti soudu v případě hromadných žalob s mezinárodním prvkem
