Tanggung Jawab Hukum Antara Notaris Dengan Kliennya Dalam Pembuatan Akta Otentik

Making an authentic deed involves two parties, namely the client and the notary, it is called a reciprocal agreement and therefore creates rights and obligations for each party. If in the exercise of rights and obligations between the notary and the client, one of the parties does not carry out an achievement, it will result in legal responsibility. The purpose of this research is to know the implementation process of the authentic deed making agreement, the rules and rights and obligations between the client and the notary and legal responsibility if there is an error on the basis of default and / or acts against the law. This study uses a normative approach which examines legal aspects, legal principles and legal principles relating to the responsibilities between notaries and clients. The type of research used in this research is descriptive research which clearly describes the legal responsibility between clients and notaries in the implementation of authentic deeds. The results of this study indicate that in the process of implementing an authentic deed-making agreement, prior to the agreement, the client and the notary must fulfill administrative and legal requirements. At the time of the agreement, it is marked by the signing of an agreement letter for making authentic deeds that have been made by the Notary based on the standard agreement. After the agreement occurs, a binding legal relationship arises and creates rights and obligations. The rights and obligations of the client to get compensation and pay the cost of making the deed, the rights and obligations of the notary to receive payments and provide compensation. If in the implementation of the deed, one of the parties does not fulfill his rights and obligations, then he must be responsible for the basis of default in accordance with Article 1243 of the Civil Code and if one of the parties violates the applicable regulations then he can be held accountable based on an act against the law in accordance with Article 1365 of the Civil Code
