Konsep Harta Bersama Dalam Perspektif Hukum Islam, Hukum Perdata dan Hukum Adat (Studi Terhadap Pembagian Harta Bersama Akibat Perceraian)

Joint assets are assets acquired by husband and wife during the marriage until the marriage ends. The formation of joint assets, namely counting from the time the marriage contract is carried out until the time the marriage is broken, either because one of the parties has passed away or because of divorce. The formulation of the problem of this research is how the concept of joint assets according to the perspective of Islamic law, civil law and customary law and how to compare the distribution of joint assets in case of divorce in terms of Islamic law, civil law and customary law. The purpose of this research is to find out how the concept of collective assets according to the perspective of Islamic law, civil law and customary law. As well as to find out how the comparison of the distribution of joint assets in case of divorce in terms of Islamic law, civil law and customary law. The type of research used is descriptive with a juridical-normative approach. The data collection method used is library research (Library Research). The analytical method used is qualitative. The result of the research is that joint assets are assets obtained during the marriage bond. Meanwhile, the comparative division between Islamic law, civil law and customary law is that each husband and wife gets ½ part of the collective assets.
