La prostitution en Corée (du sud) : entre exploitation, autorisation, pénalisation et tolérance (fin XIXe-XXIe)

Prostitution has always been a subject of debate in many world governments and South Korea is no exception to that fact. This thesis explores how the different governments in power have institutionalised prostitution. While tracing the history of the Korean Peninsula, this work will highlight and study the various policies and laws implemented by foreign governments in Korean. Mainly the Japanese Empire during the protectorate (1905-1910) then during the colonisation (1910-1945). The Japanese during this period tended to institutionalise prostitution by authorising it and by supervising it strictly, particularly when creating comfort zones and operating thousands of Korean sex slaves (wianbu 위안부 (慰安婦). This work will also focus on policies made by the military government of the United States (1945-1948). Who as soon as they arrived, proceeded to abolish the old Japanese laws, prohibiting some ways of prostitution (trafficking). Since it was not totally abolished, it could still remain. The US government established several laws when it comes to prostitution, which served to manage the growing number of South Korean soldiers and women victims of venereal disease. Despite the advent of the first officially elected South Korean government during the election of Syngman Rhee in 1948, and after the end of the Korean War in 1953, the United States military government remained in Korea to oversee the proper maintenance of order. So follows the creation of special districts bringing together military bases, neighbouring villages and brothels. Military prostitution is at its peak in the 60s and 70s. Finally, it was the turn of the autonomous South Korean regime to set up in the 1980s a form of sex tourism. As the new century dawns, the South Korean government banned prostitution on minors then a few years later, in 2004, officially prohibited prostitution with the advent of two separate laws. This criminalisation of prostitution gave rise to a pro-prostitution South Korean feminist movement. These women, despite several demonstrations, petitions and constitutional appeals are at an impasse. This work ends with the conclusion that even if prostitution has become illegal, it remains firmly anchored in the landscape and in South Korean customs.La prostitution a toujours été matière à débats au sein de nombreux gouvernements mondiaux et la Corée du sud ne fait pas exception. Ce mémoire explore la façon dont les différents gouvernements au pouvoir ont institutionnalisé la prostitution. Retraçant l’histoire de la péninsule coréenne, ce travail met en lumière et étudie les différentes politiques et textes de lois mis en œuvre par les gouvernements étrangers en Coréen à savoir l’Empire japonais durant le protectorat (1905-1910) puis pendant la colonisation (1910-1945) s’est enclin à institutionnaliser la prostitution en l’autorisant, puis en l’encadrant de façon stricte notamment lors de création de zones de confort et l’exploitation de milliers d’esclaves sexuelles coréennes (wianbu 위안부 (慰安婦). Puis, ce travail se focalisera sur les politiques du gouvernement militaire des États-Unis (1945-1948). Dès leur arrivée ils abolissent les anciennes lois japonaises et interdisent une certaine forme de prostitution (les trafics). La prostitution encadrée pouvait donc demeurer. Ils instaurent plusieurs lois encadrant la prostitution, et qui servent à gérer le nombre croissant de soldats et de femmes sud-coréennes victimes de maladie vénérienne. Malgré l’avènement du premier gouvernement officiellement sud-coréen avec l’élection de Syngman Rhee en 1948, et la fin de la guerre de Corée en 1953, le gouvernement militaire États-Unis reste en Corée pour superviser le bon maintien de l’ordre. S’en suit donc la création de districts spéciaux regroupant bases militaires, villages avoisinants et bordels. La prostitution militaire est à son apogée dans les années 60 et 70. Enfin, c’est autour du régime autonome sud-coréen de mettre en place dans les années 80 une forme de tourisme sexuel. À l’aube du nouveau siècle, le gouvernement sud-coréen interdit la prostitution sur mineures puis quelques années plus tard, en 2004, interdit officiellement la prostitution avec l’avènement de deux lois distinctes. Cette pénalisation de la prostitution a fait naitre un mouvement féministe Sud-Coréen pro-prostitution. Ces femmes, malgré plusieurs manifestations, pétitions et recours constitutionnels, sont dans une impasse. Ce travail se termine sur la conclusion suivante, même si la prostitution est devenue illégale, elle reste bel et bien ancrée dans le paysage et dans les mœurs sud-coréennes
