Los derechos sociales en Colombia y el principio de sostenibilidad fiscal

The main characteristic that differentiates social or second-generation rights is that they force the state to provide services like health, education, housing, or social security. As a historical category among fundamental rights, these rights have had an important constitutional development in many legal systems, including the Colombian system. The problem of justice concerning these rights has led the Colombian government to enact a constitutional reform that established the principle of financial sustainability, whose originality has led to many questions on its applicability and constitutionality.Los derechos sociales o de segunda generación se caracterizan por obligar al Estado a realizar prestaciones como salud, educación, vivienda o seguridad social. Como categoría histórica de los derechos fundamentales, estos presentan un desarrollo constitucional importante en algunos ordenamientos jurídicos como el colombiano. La problemática sobre su justiciabilidad ha llevado al Gobierno colombiano a realizar una reforma constitucional con la cual se instauró el Principio de Sostenibilidad Fiscal, el cual, debido a su originalidad, presenta muchos interrogantes sobre su aplicabilidad y constitucionalidad
