LA LÍNEA DEL HORIZONTE TRANSICIONAL Y LOS PROBLEMAS DE PROCESAR CRÍMENES DE LESA HUMANIDAD EN MÉXICO: UN ANÁLISIS DE SUS DOCUMENTOS CLAVE

The situation in Mexico differs substantially from other forms of violence in the Latin American region. For this reason, the answer from the Criminal Law must accommodate to that Mexican novelty. This paper analyses how the perspective of transitional justice has been tackled by different sectors, both from the official side and the citizenry one, to deal with serious violations of human rights in the Mexican past and present, and the problems encountered by that transitional justice approach, especially the difficulty of applying International Criminal Law. It concludes by assuming the figure of crimes against humanity to face some of the gravest branches of human rights in Mexico, despite the procedural and material problems with which it would be applied, even nowadays, in the Mexican legal system. La situación en México difiere sustancialmente de otras manifestaciones de violencia regionales, por lo que una respuesta desde el ordenamiento jurídico penal debe acomodarse a esa falta de precedentes. Este texto analiza cómo la perspectiva de la justicia transicional se ha planteado desde distintos sectores, tanto oficiales como de la sociedad civil, para tratar violaciones graves de derechos humanos en el pasado y en el presente mexicanos, así como los problemas con los que se ha encontrado ese enfoque, especialmente la dificultad para aplicar el Derecho Penal Internacional. Se concluye que el crimen de lesa humanidad es la figura penal internacional idónea para tratar algunas de las violaciones más graves de derechos humanos en México, a pesar de los problemas procesales y materiales con que se toparía, aun hoy, la aplicación de este tipo en el ordenamiento jurídico del país.
