ANALISIS YURIDIS PUTUSAN MAHKAMAH AGUNG NOMOR 44 TAHUN 2019 ATAS PERATURAN KOMISI PEMILIHAN UMUM NOMOR 5 TAHUN 2019 DALAM PERSPEKTIF HUKUM ADMINISTRASI NEGARA

ABSTRACT The birth of PKPU No. 5 of 2019 concerning the determination of the elected candidate pair, determination of seat acquisition, and determination of the elected candidates in the general election. However, this PKPU did not run smoothly, especially in relation to the provisions of Article 3 paragraph (7). Then on October 28, 2019 the Supreme Court decided related to the request for a judicial review by Rachmawati Soekarnoputri et al, which in article 3 paragraph (7) states that the KPU made new norms not in accordance with Law No. 7 of 2017 concerning Elections so that it contradicts Law no. 7 About Elections. This research is a normative juridical research, which is analyzing from a Supreme Court decision, the source of the legal materials used in this study are primary, secondary, and tertiary legal materials. Using qualitative methods. From the results of this study it can be seen how the implications of the Supreme Court decision Number 44 of 2019 on the results of the 2019 presidential election and the legal politics of PKPU Number 5 of 2019Keywords: Juridical Analysis, Implications of Supreme Court Decisions, Politics of KPU Regulations, Presidential Election.ABSTRAK Lahirnya PKPU No. 5 Tahun 2019 tentang penetapan pasangan calon terpilih, penetapan perolehan kursi, dan penetapan calon terpilih dalam pemilihan umum. Namun PKPU ini tidak berjalan mulus khususnya terkait, dalam ketentuan pasal 3 ayat (7). Kemudian tanggal 28 Oktober 2019 MA memutus terkait dengan permohonan uji materil oleh Rachmawati Soekarnoputri dkk yang mana pada pasal 3 ayat (7) bahwa KPU membuat norma baru tidak sesuai dengan UU No. 7 Tahun 2017 Tentang Pemilu sehingga bertentangan dengan UU No. 7 Tentang Pemilu. Penelitian ini merupakan penelitian yuridis normatif, yang bersifat menganalisa dari sebuah putusan MA ,sumber bahan hukum yang digunakan dalam penelitian ini adalah bahan hukum primer, sekunder,dan tersier. Menggunakan metode kualitatif.
