Ajustes jurisdiccionales por razón de género en las listas de representación proporcional: una acción afirmativa judicial

Guaranteeing women’s political rights, particularly the right of being elected to public office has produced the necessity of implementing affirmative actions different from legislative and or administrative ones through judicial action by the Mexican Electoral Court of the Federal Judiciary. This activity is conceived as normative judicial creation. Analyzing this circumstance presents problematics at an argumentative and institutional level from a perspective of legal correction and the roll that the Electoral Court seeks to play in the checks and balances system. Esta labor se concibe como una creación normativa judicial, cuyo análisis presenta problemáticas en los ámbitos argumentativo e institucional, desde una perspectiva de su corrección jurídica y del rol del tepjf en el sistema de división de poderes.
