El tratamiento de la infancia y los derechos del niño en el sistema legal de al-Andalus y el derecho mālikí

Study of some of the fundamental aspects on the rights that the mālikī legal system applied in Andalus provides for children at different developmental stages of childhood, even before birth, both in terms of material wealth and as the emotional and psychological. Among others, attention is lent to the rights of custody (ḥaḍāna), trusteeship exercised by the father or another (wālī), the protection of minors and special protection of orphans and abandoned children.Estudio de algunos de los aspectos fundamentales sobre los derechos que el sistema jurídico mālikí aplicado en al-Andalus contempla para los niños en las distintas fases de la infancia, incluso desde antes de nacer, tanto desde el punto de vista material y patrimonial como de los afectivos y psicológicos. Entre otros, se abordan los derechos de guarda y custodia (ḥaḍāna), tutela ejercida por el padre u otro (wālī), protección del patrimonio del menor y especial protección de huérfanos y niños abandonados
