Diversi Dalam Penyelesaian Tindak Pidana Pencurian Oleh Anak Sebagai Upaya Perwujudan Restorative Justice (Studi Kasus Pengadilan Negeri Karanganyar Perkara Nomor 3/Pid.Sus-Anak/2020/PN.Krg )

The crime of theft that often occurs in the community is not only commited by adults but also by children. Settlement of juvenile cases must prioritize the principles of children rights to protect the rights of the child concerned where arrest, detention and imprisonment are carried out as a last resort. The juvenile criminal justice system is obliged to prioitize a restorative justice approach through diversion efforts to prevent children from negative stigma so that children can return to the social environment in a reasonable manner. Diversion is a settlement of juvenile cases from the criminal justice process to processses outside of criminal justice. In the application of diversion, it is necessary to pay attention to the factors behind children commiting criminal acts because in general the position of children asvictims of adults and their surroundings. Therefore, it’s necessary to have proper and mature legal considerations and cooperation beetween law enforcement officials in a otimalway in resolving children cases through diversion efforts with a restorative justice approach in the best interest of the child
