PERTANGGUNGJAWABAN PIDANA ORANG TUA ATAS EKSPLOITASI ANAK SEBAGAI PENGEMIS DI JALAN

Every child has basic rights that needs to be protected. Parents have obligations and responsibilities to protect and fulfil those basic rights. Parents often make their children as a source to gain materialistic benefits. A research with the title “Criminal Liability of Parents and Child Exploitation as Beggars on The Streets” aims to know how criminal liabilities to parents that exploit their children. This research is an normative law research which data was gathered through literature review and interviews with interviewees. The result from this research is parents can be held responsible criminally if proven guilty, but practical cases of child exploitation often are not dealt through the legal way. Case resolution to child exploitation is not fully right with provisions of the law yet. The form of criminal liability to parents that does child exploitation is limited with a solution of non legal channels by sending the parents to rehabilitation. All parties that are involved such as the government or the community has to socialize to the whole community of Indonesia, so understanding about child exploitation and raising the awareness to childrens that have been a victim of it
