Legal Standing Of International Treaties In The National Legal System

This paper discusses the issue of the legal standing of international treaties in the national legal system. International agreements within the framework of the national legal system still raise a problem. This problem is rooted in the lack of clarity about the doctrine adhered to by Indonesian law. The approach method in this paper uses the normative juridical method. The findings in this paper state that an agreement can be effective in the end depending on the national practice of each country. A country is responsible for implementing treaties in a national setting. If its application violates international law, a country cannot use the provisions of its national law as a defence and justification for the violation.
