PERAN MEDIATOR DALAM PENYELESAIAN SENGKETA WARIS BERDASARKAN PERMA NOMOR 1 TAHUN 2016 TENTANG PROSEDUR MEDIASI DI PENGADILAN (Studi di Pengadilan Agama Malang Kelas 1 A)

ABSTRACTMediation is a mandatory process carried out by the parties in the settlement of inheritance disputes in a religious court which requires a third party as a mediator. The obedience of a religious court in the implementation of mediation in accordance with positive law is also one of the factors for the success of mediation, the continuation of the results of mediation as a result of the law has also been regulated in these laws and regulations In this paper, proposes 3 discussions, namely the suitability of PERMA No. 1/2016 and its practice in Malang Religious Court Class 1 A, the role of the mediator during the mediation process and the legal consequences of the results of the mediation. This type of research used in this paper is juridical empirical with the research location in Malang Religious Court Class 1 A. In terms of implementation with positive law is appropriate. A mediator acts as a catalyst, facilitator in the ongoing mediation process and is non-judgmental. As well as the legal consequences obtained when the peace agreement has been strengthened into a peace deed, the peace deed has permanent legal force.Keyword: Mediation, Role of mediators, Perma No.1 Year 2016, Legal Consequences ABSTRAKMediasi merupakan proses wajib dijalankan para pihak dalam penyelesaian sengketa waris di pengadilan agama yang membutuhkan pihak ketiga sebagai mediator. Ketaatan suatu peradilan agama dalam pelaksanaan mediasi yang sesuai dengan hukum positif juga menjadi salah satu faktor keberhasilan mediasi, kelanjutan hasil mediasi sebagai akibat hukumnya pun telah diatur dalam peraturan perundang-undangan tersebut. Dalam penulisan ini mengemukakan 3 pembahasan yaitu mengenai kesesuaian antara PERMA No 1/2016 degan prakteknya di Pengadilan Agama Malang Kelas 1 A, peranan mediator pada saat proses mediasi serta akibat hukum dari hasil mediasi tersebut. Jenis Penelitian yang digunakan dalam penulisan ini yaitu yuridis empiris dengan lokasi penelitian di Pengadilan Agama Malang Kelas 1 A. Dalam hal antara pelaksanaan dengan hukum positif telah sesuai. Seorang mediator berperan katalisator, fasilitator dalam proses mediasi berlangsung serta tidak bersifat memutus. Serta akibat hukum yang diperoleh ketika kesepakatan damai telah dikuatkan menjadi akta perdamaian, maka akta perdamaian tersebut memiliki kekuatan hukum tetap.Kata kunci: Mediasi, Peran mediator, Perma No 1 Tahun 2016, Akibat Huku
