PERLINDUNGAN HUKUM BAGI KONSUMEN PDAM DELTA TIRTA DI KABUPATEN SIDOARJO TERHADAP PEROLEHAN AIR YANG TIDAK LAYAK

AbstractThe purpose of this study is to analyze how the form of PDAM Delta Tirta accountability for losses that affect the community and legal action for the community who is harmed by PDAM Delta Tirta which receives inappropriate air. This type of research uses normative legal research. The methods used include; Approach to the Law, Conceptual Approach. Through this research, the researcher offers class action which is a civil indictment linked with the request (infuncition) or compensation that has been submitted by several people (the number is not many, for example one or two people). Regional Drinking Water Company (PDAM) Delta Tirta Sidoarjo is a regionally owned company in the field of clean water services. There are many complaints about the PDAM Delta Tirta service. The existence of consumer complaints about the poor quality of PDAM services, namely PDAM Delta Tirta is still less productive. This makes consumers feel they are not getting good service. In this research, the writer will discuss about the Consumer Protection Law of PDAM Delta Tirta Sidoarjoto regarding the provision of water that is not suitable for use through a class action lawsuit, so that consumers get compensation.Keywords: class action lawsuit: PDAM; protection lawAbstrakTujuan penelitian ini adalah untuk menganalisa bagaimanakah bentuk Pertanggung Jawaban PDAM Delta Tirta terhadap kerugian yang dialami masyarakat dan upaya hukum bagi masyarakat yang di rugikan oleh PDAM Delta Tirta yang memperoleh air yang tidak layak pakai. Jenis penelitian menggunakan penelitian hukum normative. Metode yang digunakan antara lain; Pendekatan Undang-Undang, Pendekatan Konseptual. Melalui penelitian ini, peneliti menawarkan untuk adanya class action yang merupakan suatu dakwaan perdata yang dikaitkan bersama permintaan (infuncition) ataupun kompensasinya yang sudah diajukan beberapa orang (jumlahnya tidak banyak misalnya satu ataupun dua orang). Perusahaan Daerah Air Minum (PDAM) Delta Tirta Sidoarjo merupakan Badan Usaha Milik Daerah di bidang pelayanan air bersih. Ada banyak keluhan tentang pelayanan PDAM Delta Tirta. Adanya keluhan konsumen tentang buruknya kualitas pelayanan PDAM artinya PDAM Delta Tirta masih kurang produktif. Hal tersebut membuat konsumen merasa tidak mendapatkan pelayanan yang baik. Dalam penelitian ini penulis akan membahas tentang Undang-undang Perlindungan Konsumen PDAM Delta Tirta Sidoarjoto tentang pengadaan air yang tidak layak pakai melalui gugatan perwakilan kelompok sehingga konsumen mendapatkan ganti rugi
