Rzecznik Małych i Średnich Przedsiębiorców jako wyspecjalizowany organ ochrony praw przedsiębiorców – iluzja czy rzeczywistość?

The aim of the article is to present the institution of the Ombudsman for Small and Medium-sized Enterprises as a body specializing in protecting the rights of entrepreneurs. The SME Ombudsman’s task as a new body is to support entrepreneurs. The article also presents the administrative and legal position of the SME Ombudsman in the system of legal protection bodies. The thesis of the study is that the SME Ombudsman is a specialized body in the catalog of legal protection bodies, whose tasks include the protection of the rights and interests of entrepreneurs operating in Poland. The legislator regulates the appointment procedure and competences of the SME Ombudsman, but his position in the public administration apparatus is not clearly specified.Celem artykułu jest przedstawienie instytucji Rzecznika Małych i Średnich Przedsiębiorców jako organu specjalizującego się w ochronie praw przedsiębiorców. Zadaniem Rzecznika MŚP jako nowego organu jest wsparcie przedsiębiorców. W artykule opisano również pozycję administracyjno-prawną Rzecznika w systemie organów ochrony prawnej.
