PEMUNGUTAN ROYALTI HAK CIPTA OLEH LEMBAGA MANAJEMEN KOLEKTIF

The enactment oflaw No. 28 of 2014 on copyright,gave birth to a new institution that has the authority to levy royalties. Royalties are the rights of creators in exchange for the use of his creation for commercial purposes . This study aims to determine the right base LMK in collecting royalties and to know the mechanism of dispute settlement that may arise between the creator with LMK.In this study the authors use the method of normative legal research, namely a study to find a legal rule , principles of law , as well as legal doctrine that is intended to address legal issues. The research conducted by the author in this thesis examines the positive law , principles of law , as well as legal doctrine that is intended to answer the problems in the formulation of research problems. Based on the discussion can be concluded that : The existence of an agreement granting the power of the creator to LMK, LMK into the right base to levy royalties. The collection of royalties is done yearly. To simplify the calculation of the amount of royalties to be paid users . As for distribution , there is every three months , and there are annual . While the settlement of disputes which may arise between the creatorwith LMK as follows: a. Disputes as out of court settlement, b. Settlement of civil dispute
