Isojaon aikaisen rantarajan määrittäminen

The purpose of this study was to examine the methods of defining the shore boundaries during the period of the Basic Land Consolidation. In the literature section of the study, the shore boundary legislation from the period was examined along with the regulations and recommendations related to defining the location. The causes of the shoreline changes were also reviewed. The aim of studying the changes in the shoreline was to determine whether they had any impact on the regional dimensions of the property. Based on the case law and the legal literature, the regional dimension of the register unit is fixed unless it is changed by a legally valid judgement. As a result, any temporary or permanent changes occurring on the ecotone between the land and the water have no effect on the land ownership and the property boundaries. Due to the Finnish legal system also the location of the shore boundaries is static even though their location has initially not been judicially confirmed in the Basic Land Consolidations except for only in rare cases. If the shore boundary from the period of the Basic Land Consolidation has not been confirmed previously by a legally valid judgement, the location should be defined in a possible boundary survey based on the requirements of the interested parties and on another available statement on the matter. To support the land surveyors in their investigation, the National Land Survey has developed some guidelines to assist in defining the location of the shore boundary that was established during the Basic Land Consolidation. In addition to the guidelines, there are regulations that need to be considered in the shore boundary surveys. The methods of delivering and defining the old shore boundaries were examined in the empirical part of the study. The research material consisted of unconfirmed shore boundaries that were formed during the Basic Land Consolidation and shore boundaries that were judicially confirmed after the Basic Land Consolidation but which had become unclear. Based on the analysis that was performed, the conclusions made by the land surveyors have been in accordance with the Real Estate Formation Act and the criterion concerning the locations of the old shore boundaries have conformed to the principle of unfettered consideration of evidence of the Real Estate Formation Act. Based on the study, the number of old shore boundary related boundary surveys performed in the 21st century is quite low. Despite this, no significant problem areas were found and therefore the current guidelines of the National Land Survey related to the old shore boundaries can be considered sufficient. The analysis of the research material indicated that the land surveyors' practice of defining the old shore boundaries has been greatly homogenous regardless of the land survey office. As a result it was determined that the interested parties have received uniform and equally good service. Based on the study, any specific recommendations to change the guidelines related to old shore boundaries are not given, but it is good to pay constant attention to maintaining and updating the guidelines, as well as to the training of the land surveyors in the National Land Survey.Tämän tutkimuksen tarkoituksena oli selvittää isojaon aikaisen rantarajan määrittämisen toimituskäytäntöä. Kirjallisuusosiossa tutkittiin aihetta käsittelevää lainsäädäntöä sekä sijainnin määrittämiseen liittyviä määräyksiä ja suosituksia. Tutkimuksessa perehdyttiin myös rantaviivamuutosten taustalla oleviin syihin. Rantaviivamuutoksia tutkimalla haluttiin selvittää sitä, onko niillä vaikutusta kiinteistön alueelliseen ulottuvuuteen. Oikeuskäytännön ja oikeuskirjallisuuden perusteella rekisteriyksikön alueellinen ulottuvuus on muuttumaton, ellei sitä lainvoimaisella päätöksellä muuteta. Tästä johtuen mitkään tilapäiset tai pysyvät maan ja veden välisellä vaihettumisvyöhykkeellä tapahtuvat muutokset eivät muuta maanomistusta ja kiinteistörajoja. Suomen oikeusjärjestyksen seurauksena myös rantarajojen sijainti on staattinen, vaikka niiden paikkaa ei ole alun perin oikeusvoimaisesti isojaoissa vahvistettu kuin poikkeuksellisesti. Jos isojaon aikaisen rantarajan sijaintia ei ole aikaisemmin lainvoimaisesti määrätty, on mahdollisessa rajankäynnissä rantarajan paikka ratkaistava asianosaisten vaatimusten ja muun asiasta saatavan selvityksen perusteella. Toimitusinsinöörien selvitystyön tueksi on Maanmittauslaitos laatinut ohjeita, jotka auttavat isojaon aikaisen rantarajan sijaintia koskevaa määritystyötä. Ohjeiden lisäksi on annettu myös määräyksiä, jotka on huomioitava rantarajankäyntitoimituksissa. Tutkimuksen empiirisessä osassa selvitettiin vanhoja rantarajoja koskevaa toimituskäytäntöä. Tutkimusaineisto koostui isojaossa muodostuneista vahvistamattomista sekä isojaon jälkeen oikeusvoimaisesti vahvistetuista vanhoista rantarajoista, jotka olivat muuttuneet epäselviksi. Analyysin perusteella toimitusinsinöörien ratkaisut ovat olleet kiinteistönmuodostamislain mukaisia ja vanhojen rantarajojen sijaintia koskevat näyttöperusteet ovat noudattaneet kiinteistönmuodostamislain mukaista vapaata todistusteoriaa. Tutkimuksen perusteella vanhoja rantarajoja koskevia rajankäyntejä ei ole suoritettu lukumääräisesti kovinkaan monia 2000-luvulla. Tutkimuksessa ei löydetty merkittäviä ongelmakohtia, joten Maanmittauslaitoksen nykyohjeistusta vanhoja rantarajoja koskevissa toimitustilanteissa voidaan pitää lähtökohtaisesti riittävänä. Tutkimusaineiston analyysi osoitti, että toimitusinsinöörien vanhoja rantarajoja koskeva määrityskäytäntö on ollut hyvin pitkälti homogeenista maanmittaustoimistosta riippumatta. Tämän perusteella asianosaiset ovat saaneet tasalaatuista ja yhdenvartaista palvelua. Tutkimuksen perusteella varsinaisia suosituksia vanhoja rantarajoja koskevan ohjeistuksen muuttamiseksi ei anneta, mutta niiden ylläpitämiseen, päivittämiseen ja toimitusinsinöörien koulutukseen Maanmittauslaitoksessa on hyvä kiinnittää jatkuvaa huomiota
