European Union Asylum Policy. The Development of the Dublin System in 1997 - 2014

Šiame darbe nagrinėjama ES prieglobsčio politikos Dublino sistemos raida per prieglobsčio prašytojo intereso perspektyvą. Pagal šią sistemą nustatoma atsakinga valstybė narė už trečiosios šalies piliečio vienoje iš dalyvių pateikto prieglobsčio prašymo nagrinėjimą. Darbe nagrinėtos sistemos permainos prieglobsčio prašytojui suteikiamų garantijų atžvilgiu, priėjimo prie prieglobsčio procedūros garantavimo prasme bei šeimos vientisumo gerbimo aspektu, taip pat sistemą formavę faktoriai minėtais aspektais. Sistemos pasikeitimai turėjo teigiamos įtakos prieglobsčio prašytojų, kuriems taikoma Dublino procedūra, situacijai. Atsakomybės už prieglobsčio prašymo nagrinėjimą nustatymo laikotarpį siekta numatyti optimalų, derinant valstybių narių praktines galimybes bei prieglobsčio prašytojų interesą. Priėjimo prie prieglobsčio procedūros prasme aktualiausia buvo sistemos prielaida, jog visos Dublino sistemos dalyvės yra automatiškai saugios, nors praktika parodė priešingus rezultatus. Pripažinus, jog dėl ypatingai didelio krūvio valstybės narės prieglobsčio sistemoje gali atsirasti sisteminių trūkumų, buvo įtvirtintas išankstinio reagavimo į prieglobsčio krizes mechanizmas. Dublino sistema pradžioje beveik nenumatė jokių teisių prieglobsčio prašytojams, tačiau ilgainiui įtvirtinta teisė apskųsti perdavimo sprendimą su minimaliu suspensyviniu efektu, nuostatos, ribojančios sulaikymą bei įpareigojančios valstybes nares visapusiškai informuoti prieglobsčio prašytoją apie sistemos veikimo principus. Analizė taip pat parodė, jog sistemos veikimo pradžioje beveik nebuvo atsižvelgta į prieglobsčio prašytojo turimus šeiminius ryšius valstybėse narėse, tačiau ilgainiui šios aplinkybės kaip pagrindas atsakomybės priskyrimui tapo vis reikšmingesnės, įtvirtinus kelis naujus šeimos kriterijus bei numačius aukštesnius apsaugos standartus pažeidžiamiems asmenims. Šios permainos nulemtos skirtingų aplinkybių. Bendros ES prieglobsčio politikos išraiška Dublino sistemoje buvo dėmesys nelydimiems nepilnamečiams bei kitiems pažeidžiamiems asmenims, tuo tarpu vidinės sistemos spragos vertė tinkamiau reaguoti į šeimos narius išskiriančias situacijas bei aplinkybes, galinčias sąlygoti negrąžinimo principo nesilaikymą valstybių narių teritorijose. Nors ilgainiui nacionalinių valstybių įtaka derinant naujus teisės aktus ES lygmenyje silpnėjo lyginant su EP vaidmeniu, neišpildytos Europos Komisijos intencijos bei Europos Parlamento lūkesčiai skirtingais Dublino sistemos aspektais parodė, kad nacionalinės valstybės vis dar yra pagrindinės Dublino sistemos formuotojos, o didesnių permainų galima tikėtis nebent iš Europos teisingumo teismo praktikos.The aim of this paper is to analyse the development of the Dublin system from perspective of the asylum seeker‘s interest. The Dublin system establishes criteria according to which the responsibility of the Member State for asylum seeker submitted an asylum application in one of the Member States is determined. This paper analyses how the situation of the asylum seeker have changed over the course of this system in terms of safeguards provided by the system, access to asylum procedure and respect of family unity; more importantly this paper analyses the most influential factors which have shaped the Dublin system. Having analyzed provisions and the application of the Dublin system, it can be stated that the changes of the system have made a positive impact on the situation of asylum seekers subjected to the Dublin system. The majority of the time limits established to determine the Member State responsible gradually have been made optimal by adjusting the practical possibilities of the Member States and the interest of asylum seeker. From the point of access to asylum procedure, the most important part of the system was it‘s premise of mutual trust among the Member States and observing of EU asylum standards. This assumption showed to be erroneous in practise and resulting in refoulment. Eventually it was acknowledged that particular pressure may cause deficiencies of the asylum system of particular States and therefore the mechanism of an early warning, preparedness and management of asylum crises was imbedded in the legal act. From the very start of the functioning of the Dublin system there were almost neither any rights, nor appropriate coverage of family-related responsibility criteria envisaged in the system. Eventually protection standards were strengthened and right to appeal against the transfer decision with a minimal suspensive affect has been provided; moreover, important provisions were foreseen limiting detention of asylum seekers and obliging Member States to acquaint asylum seekers with the general principles of the Dublin system, which enables an effective access to the rights. In addition, the responsibility criteria were complimented by the significant number of family criteria and regard to vulnerable persons. These changes were an outcome of different influences. While the influence from the CEAS was reflected in strengthening of rights of vulnerable persons, gaps of the Dublin system have led to enhancing of the family unity and reducing the risk of noun-refoulment. Although historically the role of national states has been sinking gradually, nonfulfillment of European Commission intentions and European Parliament expectations in different aspects of the Dublin system shows that national states still have a leading role in shaping of the Dublin system, and any significant changes may be expected only from the European Court of Justice.Vytauto Didžiojo universiteta
