PROSES PEMBUKTIAN TINDAK PIDANA KEKERASAN PSIKIS TERHADAP PEMBANTU RUMAH TANGGA

ABSTRACTEven though it has been regulated in the Law, acts of domestic violence still continue, one of the reasons is because the process of proving psychological violence in the household is considered difficult. This paper raises the problem statement as follows: 1. What are the types of psychological violence in the household sphere ?. 2. How is the modus operandi of psychological violence in the household? 3. What is the process of finding, finding and collecting evidence in criminal acts of psychological violence? This type of research is normative juridical, statutory, conceptual and case approach. The results of this study found two types of psychological violence (severe psychic and mild psychic), with modus operandi such as dirty words, exclusion, and threats. And regarding the proof needed a psychiatrist expert and the results of the examination of the victim.Keywords: Psychic Violence, Evidentiary Law, Domestic ViolenceABSTRAKWalaupun telah diatur dalam Undang-undang, namun tindakan kekerasan dalam rumah tangga masih saja berlanjut, salah satu alasannya adalah karena proses pembuktian kekerasan psikis dalam rumah tangga dianggap sulit. Karya tulis ini mengangkat rumusan masalah sebagai berikut: 1.Apa saja macam-macam kekerasan psikis dalam lingkup rumah tangga?. 2.Bagaimanakah Modus Operandi kekerasan psikis dalam rumah tangga? 3.Bagaimana proses mencari, menemukan dan mengumpulkan bukti dalam tindak pidana kekerasan psikis?. Jenis penelitian ini adalah yuridis normatif, pendekatan perundang-undangan, konseptual dan pendekatan kasus. Hasil penelitian ini ditemukan dua macam kekerasan psikis (psikis berat dan psikis ringan), dengan Modus Operandi seperti perkataan kotor, pengucilan, dan ancaman. Dan mengenai pembuktiannya dibutuhkan seorang ahli psikiater dan hasil pemeriksaan terhadap korban. Kata Kunci : Kekerasan Psikis, Hukum Pembuktian, KDRT
