ПРАВОВЕ СТАНОВИЩЕ УЧАСНИКІВ ПОЗОВНОГО ПРОВАДЖЕННЯ В ГОСПОДАРСЬКОМУ СУДОЧИНСТВІ

Purpose: the article discusses theoretical issues of the legal status of participants in lawsuits in economic proceedings based on an analysis of the current legislation and the scientific views of modern Russian scientists. Methods of research: the study was carried out using classical methods of scientific knowledge: dialectic, logical, comparative legal, analysis. Results: formulated system of common obligations of participants in a lawsuit is formulated, a legal understanding and use of the status of participants in a lawsuit in economic proceedings are given. Discussion: problems of the use by participants of lawsuits of their rights and obligations in the implementation of economic proceedings. To date, the relevance of our chosen topic is closely related to the large number of questions about the legal status of participants in litigation in commercial litigation. A large number of scholars are working on the study of the legal status of participants in litigation in commercial litigation, among them, it is worth noting the following: I.A. Balyuk, V.M. Demyak, T.V. Stepanova, O.I. Kharitonova, V.D. Chernadchuk, J. Pitts and others. First of all, I would like to note that litigation in commercial litigation differs significantly in its efficiency and simplification from similar proceedings in other types of litigation. Given that, at the same time, the efficiency and simplification of the administration of justice should not negatively affect the level of protection of the rights and legitimate interests of the participants in such proceedings. The current Code of Civil Procedure of Ukraine also does not provide the concept of «participant in the economic process», «participant in the lawsuit». First of all, we argued that the parties to the claim are legally interested persons, a substantive dispute between which is the subject of consideration and resolution in commercial litigation, whose actions or omissions in relation to another participant (participants) in the proceedings entail mutual substantive or procedural consequences. The incorrect recognition of the right to sue only to the plaintiff was determined, because first, the lawsuit in the case can also be filed by a third party who claims independent claims on the subject of the dispute; secondly, cases with homogeneous requirements and evidence can be combined by a judge into one proceeding, in which case the rights and obligations of the plaintiff will be given to several persons; thirdly, the defendant in the case has the right to file a counterclaim, the requirements for registration and filing procedure of which completely coincide with the requirements for registration and procedure for filing a claim by the plaintiff in the case.Мета: у статті розглядаються теоретичні питання правового становища учасників позовного провадження в господарському судочинстві на основі аналізу норм чинного законодавства та наукових поглядів сучасних вітчизняних вчених. Методи дослідження: дослідження проведене з використанням класичних методів наукового пізнання: діалектичного, логічного, порівняльно-правового, аналізу. Результати: сформульовано систему загальних обов’язків учасників позовного провадження, наведено правове розуміння та використання статусу учасників позовного провадження в господарському судочинстві.
