PERTIMBANGAN HAKIM DALAM MENJATUHKAN PUTUSAN TERHADAP PELAKU DALAM PERKARA TINDAK PIDANA PEMBUNUHAN ANAK DI PENGADILAN NEGERI BANTUL (STUDI KASUS PERKARA NOMOR 223/PID.B/2014/PN.BTL)

The tittle of this study is “Judge Considerations In sentencing the offender of infanticide In District Court of Bantul”. The background is regarding the role of the judge in determining the truth through judicial proceeding in the case of infanticide, where the main actor is the mother. Therefore, this case is different from others judge actions because generally, it has elements different from other case. The purpose of this study was to know the consideration in decisions of the judges in infanticide case number : 223/Pid.B/2014/Pn.Btl. The Type of Research is a normative legal research which the norms of positive law in the form of laws. Besides, The research requires secondary data as the main data and primary data as the supporting data. The results of the thesis is to punish the offender of the infanticide. In sentencing this case the judge has considered : alternative public prosecutor indictmant, prosecution of public prosecutor, evidence, the elements of Article 341 of the Criminal Code, and those things which are burdensome and ease for accused
