Willey Subject: Marketing Glen Canyon power in the Lower Basin The Arizona Power Authority was created in 1944 as a public body for the expressed public purpose of providing low cost hydro power from the Colorado River to the farmers of Arizona. This public purpose as established by the Arizona Legislature is clearly set forth in Title 3, Chapter 2, A. R. S. Section 30-121 A. R. S. paragraph A states: The Authority shall bargain for, take and receive, in its own name on behalf of the State, electric power developed from the waters of the main stream of the Colorado River by the state or the United States or any agencies thereof which by provisions of state or United States law, agreement or regulation may be made available, allotted or allocated to the State in its sovereign capacity" . Section 30-124 A. R. S. paragraph B provides: "The Authority shall not operate primarily as a source of public revenue. Electric power, as nearly as practical, shall be disposed of in an equable manner so as to render the greatest public service and at levels calculated to encourage the widest practical use of electrical energy". In order to render the greatest public service, the Legislature, by enacting Section 30-125 A. R. S.,established preferences which would apply when power supplies became insufficient to meet pending power applications. This Section gives first priority to farmers who have organized themselves into districts for the purpose of using power revenues to subsidize irrigation or for the use of power for pump irrigation. Second priority of limited preference is given to municipalities and cooperatives, which partially follows the philosophy of the federal preference laws. Having nodded to federal philosophy, the Legislature, in recognition of the primary needs of Arizona, granted a third priority ofEpson Perfection 4870 Photo, 400 dpi, 8 bit, 3,897,880 byte
