Mr ORR Legislative History of Section 7 of the Act of February 26, 1919 (40 Stat. 1175)-Establishing the Grand Canyon National Park Section 7 of the Act of February 26, 1919 (40 Stat. 1175) reads as follows: SEC. 7. That, whenever consistent with the primary purposes of said park, the Secretary of the Interior is authorized to permit the utilization of areas therein which may be necessary for the development and maintenance of a government reclamation project. The phrase "whenever consistent with the primary purposes of said park" appears to limit the Secretary's discretion in the exercise of the authority granted. In an effort to determine under what circumstances the Congress contemplated this authority would be exercised and to ascertain the factors that led up to insertion of this provision in the Act, we have reviewed the legislative history of this measure and find the following: S. 390, the bill ultimately enacted into law, as introduced by Mr. Ashurst on April 4, 1917, contained this language. SEC. 7. That the United States Reclamation Service may enter upon and utilize for flowage or other purposes any area within said park which may be necessary for the development of a government reclamation project. This language is identical to that contained in the Act of May 11, 1910, (36 Stat. 354), which authorized establishment of the Glacier National Park, the Act of January 26, 1915 (38 Stat. 798), which authorized establishment of the Rocky Mountain National Park, and the Act of August 9, 1916 (39 Stat. 442), which authorized establishment of the Lassen Volcanic National Park.Epson Perfection 4870 Photo, 400 dpi, 8 bit, 14,159,872 byte
