PENERAPAN KETENTUAN PIDANA PADA TINGKAT PENYIDIKAN TERHADAP ANAK SEBAGAI PELAKU EKSPLOITASI SEKSUAL YANG KORBANNYA ANAK

Act Number 23 Year 2002 on Children Protection gave interpretation that whatever become law part of Indonesian children started from children civil law in the aspect of parenting, guardianship, and adopting children that rule children exploitation in economic, social and sexual field. The aim of this writing is to know criminal threat implementation to child as the actor of sexual exploitation with child victim in investigation level. The method utilized in this law writing was normative law research, which was a research that reviewed prevailing positive law norm in the regulation rules concerning criminal threat implementation in the investigation level towards child of sexual exploitation actor. The conclusion of this law writing was that criminal threat implementation in investigation level toward child as the sexual exploitation actor with child victim as the Act Number 3 Year 1997 on Children Judicature and the Act Number 2003 year 2002 on Children Protection. The suggestion of this law writing was in the attempt to prevent sexual exploitation on children it was expected that from Police Force party to give socialization through elucidation and seminar on children protection especially sexual exploitation on children and the need of special prison room for children, so they did not gather with adult prisoners in order to keep children’s growth and development
