KEBIJAKAN PEMERINTAH DAERAH PROVINSI PAPUA TERHADAP PERLINDUNGAN HAK ULAYAT MASYARAKAT HUKUM ADAT BERDASARKAN OTONOMI KHUSUS BAGI PROVINSI PAPUA

This study aims to find out and evaluate the government policy of Papua Province Area on its protection effort of ulayat rights of Papua’s common law people and its problems that influence the government policy of Papua Province Area toward protection of ulayat rights of common law people. This study is conducted by using legislation approach, law history and law politic. The writer carefully observes primary law material, secondary law material, and conducts interview toward informants based on their expert in certain field. Furthermore, the writer conducts law analysis; those are positive law description, positive law systematic, positive law interpretation and assessing positive law. Through the analysis, it is found that normatively government policy of Papua Province Area on protection effort of ulayat rights for common law people of Papua had been existed. Problems that influence protection effort for ulayat rights for common law people are: there are law regulations that are less to give protection, unpreparedness, indolence, no seriousness, no maximum efforts, inconsistency local government on the implementations; common law people themselves, which sometimes do not make sure of their existence, limits and their ulayat rights possession
