Indonesia is a developing country and is going to be a modern contry. Along with its development, it emerges various kinds of complex problem. One of the serious problems is pregnancy discharging or abortion which increasingly occurs in Indonesia. The abortion cases are very often founded in society, however those which are processed in court are very few. It is influenced by the difficulties of the legal enforcing apparatus to find the evidences for conducting abortion process. Thus, legal enforcement in abortion case is very rare. Definition of abortion is the dischange of fetus before the due tim. It could be caused naturally and, secondly it happens by the human internetion. Those becomes the case is the effects of human intervention to abortion. By such way, it is conducted in force by human. In Indonesia abortion act is prohibited in this state. It significantly seems from the regulating on abortion in Criminal Code and Law On Health. Abortion action is conducted by society.
