TINJAUAN HUKUM PIDANA TERHADAP TRANSPLANTASI ORGAN DAN ATAU JARINGAN TUBUH SERTA TRANSFUSI DARAH UNTUK TUJUAN KOMERSIAL

The purpose of this research is to know how is the shape of criminal responsibility toward the execution of organ or body parts transplantation and also the blood transfusion to the commercial purposes based on Law Number 23 of 1992 on the Health. One of the shapes of advance of technology is the findings of a method to relieve the disease that could lessen the risk of death and could extend someone's life continuity. In fact, there a lot of patients that needs organ rather than the donor has opened the any change to the organ trading. Even, this practice was conducted outspokenly by attaching advantages/ announcement in mass media. Law number 23 of 1992 on the Health is only emphasize the criminal responsibility toward the people that have willingness to sell their organ, whereas there are other parties such as doctor who help to take the organ will be traded and also the part of hospital with the various ways conducts the efforts to get profits by the reason to take care the patient become 'untouchable' by this law. The first matter should be conducted to prevent this illegal practice not to increase is by reviewing the norms in this Law on Health
