PELAKSANAAN PEMBERIAN UPAH LEMBUR BAGI PEKERJA PADA PT KARYATAMA MITRA SEJATI JANTI KABUPATEN SLEMAN

The legal problem of this research was the company either provides or does not provide overtime salary to its workers who keep on working excessively to their working period. Meanwhile the workers need time for taking a rest and time for working. Thus there should be a compensation received from the time sacrifice of the workers. This research used empirical research method by samples of 3 (three) workers in PT. Karyatama Mitra Sejati Yogyakarta and the source person, i.e. Diah Savitri R, SH as Branch Manager Head of PT. Karyatama Mitra Sejati Yogyakarta. The purpose of this research was to find out and analyze whether the implementation of overtime salary providing in PT. Karyatama Mitra Sejati Yogyakarta has been appropriate to the stipulation of regulation on workers. From this research it found that in PT. Karyatama Mitra Sejati there is violation to the Article 4 paragraph 1 of Ministerial Decision of Workers and Transmigration Number 102/MEN/VI/2004 concerning on Overtime Working Period and Overtime Working Salary. It is proven by the employer which either provides or does not provide overtime salary to its workers. The employer should consider more on the rights of worker in particularly about the overtime salary. The employer also has obligation to establish the clear corporation regulation, the employer and Institution of Workers and Social of Sleman Regency has obligation to conduct the valid regulation, and the Institution of Workers and Social should give fine to the violating employers, appropriately to the fine which has been ruled in regulation
