PENEGAKAN HUKUM TERHADAP KASUS PENCEMARAN LINGKUNGAN HIDUP SEBAGAI AKIBAT PERTAMBANGAN RAKYAT di KECAMATAN PALU TIMUR KOTA PALU

Central Sulawesi is the region in Sulawesi island that is very rich with the natural resource, especially in the gold mining. The gold minning in central Sulawesi has been with the modern management or the traditional management.The negative impact of mining is pollution of the environment, human rights violations and denial of the existence of communal land. Although the mining industry is still potential to increase the prosperity of the region, development based on exploitation of natural resources lead to economic decline and environmental pollution. The role of local government is required to provide guidance, oversight and enforce the rules in terms of processing the mine intended to realize the social welfare through the cooperation of all parties to allow welfare. The gold ore minning of small scale minning still use amalgamation method as the primary method in gold ore processing. The used amalgamation on a direct result happened pollution of mercury and low gold obtainment. The impact of the community gold minning management are very danger. The objectives of this research are knowing the community gold minning system, the impact of the traditional gold minning system to the environment and the social economic of the community We hope the the result of this research will give the development system in bassed on the local natural resource pattern, the strategic of community the gold minning system for the sustainable development to empowering the community from their natural resources. This research ends with suggestions that the community gold minning system must use the close system in the production process and the integrated region for the localization of the production house
