La mediación penal: un análisis desde la regulación del Código Orgánico Integral Penal

The present work has as objective to value the legal regulation of the figure of the alternating methods of conflicts in the Code Organic Penal Integral (COIP), specifically from the perspective of the mediation. The article is divided in two parts. The first one directed to the study and analysis of the benefits and risks of the mechanisms of solution of controversies from the perspective of the restorative justice, the mediation and the reconciliation. The second part evaluates the legal regulation of these procedures in the COIP from three fundamental aspects, the objective aspect of the mediation (the crimes), the subjective aspect (the mediator’s figure) and the agreement. For the achievement of this objective the methods of investigation historical scientist were used - logical, exegetic - analytic, juridical compared and the investigation technique, analysis of documents. Their main result the analysis of the regulation of the mediation in the COIP in Ecuador, their main contradictions and positive contributions as a modern code sustained in the principle of the due process, the respect of the rights of the victims and the offenders’ guarantees.El presente trabajo tiene como objetivo valorar la regulación legal de la figura de los métodos alternos de resolución de conflictos en el Código Orgánico Integral Penal (COIP), específicamente desde la perspectiva de la mediación. El artículo se divide en dos partes. La primera dirigida al estudio y análisis de los beneficios y riesgos de los mecanismos de solución de controversias desde la perspectiva de la justicia restaurativa, la mediación y la conciliación. La segunda parte evalúa la regulación legal de estos procedimientos en el COIP desde tres aspectos fundamentales: el aspecto objetivo de la mediación (los delitos), el aspecto subjetivo (la figura del mediador) y el acuerdo. Para el logro de este objetivo se utilizaron los métodos de investigación científico histórico – lógico, exegético – analítico, jurídico comparado y la técnica de investigación, análisis de documentos. Su principal resultado el análisis de la regulación de la mediación en el COIP en Ecuador, sus principales contradicciones y aportes positivos como un código moderno sustentado en el principio del debido proceso, el respeto de los derechos de las víctimas y garantías de los infractores
