Consulta Previa, ciudadanías diferenciadas y conflicto socioambiental

The article examines the relationship between prior consultation and the construction of differentiated citizenship appropriate to multiculturalism as well as the conflictive construction of the institution of prior consultation in Colombian law, with the intention of illustrating in what way it has become a social field of dispute between diverse actors with diverse ideas about development, identity, and the common good. Finally, the article suggests some of the limitations of prior consultation as a way to manage socioenvironmental conflicts: the tendency to ethnicize the right to participate through this mechanism, the difficulty to recognize divergent epistemologies and temporalities, and to reduce the asymmetry of power and information between the actors that are part of the consultation process.El artículo examina la relación, propia del multiculturalismo, entre Consulta Previa y el surgimiento de ciudadanías diferenciadas, así como la construcción conflictiva que ha tenido dicha institución en el derecho colombiano, con el fin de ilustrar de qué manera ella se ha convertido en un campo social de disputa entre diversos actores con concepciones también diversas del desarrollo, la identidad y el bien común. Para concluir, se plantean algunas limitaciones que presenta la Consulta Previa como herramienta de gestión de conflictos socioambientales: la tendencia a etnizar el derecho a la participación que propicia este mecanismo, las dificultades para reconocer epistemologías y tem-poralidades divergentes y para reducir la asimetría de poder e información que existe entre los actores que intervienen en la consulta
