Las facultades metaconstitucionales de la presidencia de los Estados Unidos de América

The purpose of the article is to explain what the powers of the President of the United States consist of. Beyond describing what they are, it seeks to explain their existence and why they have been separated from the original ideal of “small and limited government”. The work was done using the neo- institutionalism methodology, that although it analyzes the legal and formal aspects of the institutions, it emphasizes on how they are integrated by “informal or non-written rules”. The results presented show how the President of the United States, despite the barely unchanged constitutional text, has acquired more and more powers, which have generated a powerful Executive Power, with the potential to exceed its constitutional limitsSe expone en qué consisten los poderes del presidente de Estados Unidos de América. Más allá de describir cuáles son, se busca explicar su existencia y por qué se han ido separando del ideal originario de “gobierno pequeño y limitado”. Para realizar el trabajo se utilizó el enfoque metodológico neoinstitucionalista que, si bien analiza los aspectos legales y formales de las instituciones, pone especial énfasis en cómo están integradas por “reglas informales o no escritas”. Los resultados muestran que el presidente de Estados Unidos de América ha adquirido cada vez más facultades a pesar de lo escasamente inalterado del texto constitucional, lo que ha generado un Poder Ejecutivo bastante poderoso con el potencial de rebasar sus límites constitucionales
