Prevenir para não remediar: a responsabilidade civil sob uma nova perspectiva funcional e principiológica

The purpose of this work is to rethink the effectiveness and efficiency of liability with repressive function and the institute functions in the face of current demands of society. Seek to demonstrate, from the study of the transformations of the facets of liability in the face of social change, that their current roles do not meet the volatility of contemporary society, to the extent that further damage appear every day. To this end, it analyzes critically the history of the liability and its adaptation to the risk society, as well as new techniques designed in search of compensation at all costs. From this perspective, the traditional liability should be revised to meet the principles of the 1988 Constitution, in order to ensure full protection and inviolability of the human person. To do so, it proves essential configuration of liability as institute also able to prevent injuries, with a view to effective protection of rights, redrawing the institute based on the principles of precaution and prevention, analyzing its fundamentals and its application . Finally, it is proposed mechanisms to give practical operability to those principles in civil liability.O intento deste trabalho é repensar a efetividade e suficiência da responsabilidade civil com função repressiva e as funções do instituto em face das atuais demandas da sociedade. Procura-se demonstrar, a partir do estudo das transformações das facetas da responsabilidade civil, diante das mudanças sociais, que suas atuais funções não atendem à volatilidade da sociedade contemporânea, na medida em que novos danos surgem a cada dia. Para tanto, analisa-se criticamente o histórico da responsabilidade civil e sua adaptação à sociedade de riscos, bem como as novas técnicas concebidas em busca da indenização a qualquer custo. Nessa perspectiva, a responsabilidade civil tradicional deve ser revista para atender os princípios da Magna Carta de 1988, no sentido de se garantir a inviolabilidade e proteção integral à pessoa humana. Para isso, mostra-se imprescindível a configuração da responsabilidade civil como instituto também apto a prevenir lesões, com vistas a uma efetiva tutela de direitos, redesenhando-se o instituto a partir dos princípios da precaução e da prevenção, analisando seus fundamentos e sua aplicabilidade. Por fim, propõe-se mecanismos capazes de conferir concreta operatividade aos referidos princípios no âmbito da responsabilidade civil
