Especismo e natureza jurídica dos animais: a conjugação de imagens e argumentos na apreciação do problema

This present study to analyze the controversial legal attributed to non - human animals in Brazilian law , demonstrating the unsustainability of attributing to these living beings the status of thing . To fulfill this aim , sought through a legal and philosophical analysis of arguments and images , understand who the animals and the relevance of sentience to the inclusion of non - human animals in the moral community are as well as the principle of equal consideration of interests similar erected by Peter Singer . After , is examined the history of man and his denial of the other , explaining why their speciesist position not to recognize animals as moral patients . Finally , proposed a reflection on the need to change the legal nature of animals , aventando able to consider them as subjects of rights , so that there is a more appropriate and effective protection .O presente trabalho objetiva analisar a controversa natureza jurídica atribuída aos animais não-humanos no ordenamento jurídico brasileiro, demonstrando a insustentabilidade de se atribuir a estes seres vivos o status de coisa. Pra cumprir tal desiderato, buscou-se através de uma análise jurídica e filosófica de argumentos e imagens, compreender quem são os animais e a relevância da senciência para a inclusão de animais não-humanos na comunidade moral, bem como o princípio da igual consideração de interesses semelhantes erigido por Peter Singer. Após, passa-se a examinar o homem e seu histórico de negação do outro, elucidando o porquê de sua postura especista de não reconhecer animais como pacientes morais. Por fim, propõem-se uma reflexão sobre a necessidade de se alterar a natureza jurídica dos animais, aventando a possibilidade de considera-los como sujeitos de direitos, a fim de que haja uma tutela mais adequada e eficaz
