A utilização das peças de informações inquisitoriais como meio probatório no processo penal

This work has as its objective to analyze the police investigation, analyzing, from the impact of preliminary investigations in the life of the investigated to the legal nature of the police investigation, weaving also considerations about the existence of possible use of the information produced there as part evidence in criminal prosecution. Therefore, this study has important considerations for the system governing the police investigation in Brazil, analyzing also the (lack of) legitimacy of the police investigation, doing also a brief analysis of the impact of the police investigation in the life of the alleged practitioner of the criminal offense. Finally, it is concluded that for the inquisitorial parts to be provided with probative value, the information produced at the police headquarters must be ratified by the judicial authority that will preside over the criminal prosecution to be triggered, allowing the defendant the opportunity to defend themselves and revolt in relation to elements there produced, ensuring also that the principles inherent in the criminal proceedings are safeguarded during prosecution.Este trabalho tem como função analisar o inquérito policial, analisando, desde a repercussão das investigações preliminares na vida do investigado até a natureza jurídica da investigação policial, tecendo, ainda, considerações acerca da existência da possibilidade de utilização dos elementos de informação ali produzidos como elemento probatório na persecução penal. Para tanto o presente trabalho traz considerações importantes sobre o sistema que rege o inquérito policial no Brasil, analisando, ainda, a (des)legitimidade da investigação policial, fazendo-se, ainda, uma breve análise sobre a repercussão da investigação na vida do suposto praticante da infração penal. Por fim, conclui-se que, para que as peças inquisitoriais possam ser dotadas de valor probatório, necessário se faz que os elementos de informação produzidos em sede policial sejam ratificados pela autoridade Judiciária que presidirá a persecução penal a ser deflagrada, de forma que se possibilite ao réu a oportunidade de se defender e insurgir em relação aos elementos ali produzidos, garantindo-se, ainda, que os princípios inerentes ao processo penal sejam resguardados durante a persecução penal
