This article has the purpose to analyze the Bill 867/2015, which aims to include the Escola Sem Partido (Non-Party School between the guidelines and bases of Brazilian education, in light of the rules and principles enshrined in the Federal Constitution. The demand for the affirmation of (supposed) neutrality as the basic principle of Brazilian education will be discussed through the thought of the sociologist Pierre Bourdieu.
