Controle jurídico do ambiente educacional: uma análise da (in)constitucionalidade do Projeto de Lei 867/2015

This article has the purpose to analyze the Bill 867/2015, which aims to include the Escola Sem Partido (Non-Party School between the guidelines and bases of Brazilian education, in light of the rules and principles enshrined in the Federal Constitution. The demand for the affirmation of (supposed) neutrality as the basic principle of Brazilian education will be discussed through the thought of the sociologist Pierre Bourdieu. It is based on the premise that the education system is inserted in the field of dispute for symbolic power to investigate the political interest of ESP in the way knowledge is produced and disseminated in the school environment.Este artigo tem por escopo analisar o Projeto de Lei 867/2015, que visa incluir o “Programa Escola sem Partido” entre as diretrizes e bases da educação brasileira, à luz das regras e princípios consagrados na Constituição Federal. O pleito pela positivação da (suposta) neutralidade como princípio basilar da educação pátria será discutido através do pensamento do sociólogo Pierre Bourdieu. Trata-se de partir da premissa de que o sistema de ensino se insere no campo de disputa por poder simbólico para investigar qual é o interesse político do ESP na forma pela qual o conhecimento é produzido e disseminado no ambiente escolar
