This work deals with the epistemological status of truth in the judicial process, analyzed with basis on the concept of truth as proposed by the philosophical theory of Jürgen Habermas. Through a literature revision, one aims to identify how truth is manifested adequately in the judicial process. By explicitating how truth is built in the judicial process, the objections to the possibility of obtaining truth and the theories of truth as correspondence and discursive truth are analyzed. The inadequacy and the theoretical unsustainability on the truth as correspondence paradigm is verified, concluding by the necessary adoption of a paradigm of discursive truth.Este trabalho trata do status epistemológico da verdade no processo judicial, anali...
