Legitimacy of law: a comparative reading in the studies of Max Weber and Jürgen Habermas

The present research, through a theoretical and comparative methodology, analyzes the legitimacy of the law, considering its social as well as political importance. In order to approach the legitimacy of law, the conceptions of Max Weber and Jürgen Habermas are investigated and used, due to the nuances brought by these authors on the subject. Thus, it is sought to carry out a theoretical debate among the students, establishing a parallel between the contributions and possible deficiencies of both theories for the thematic of the legitimacy of the law. Finally, some analyzes and reflections on the subject are carried out, with the support of the contributions of scholars on the subject, as well as the effectiveness of discursive validation processes in the context of current societies and the limitations they face in the context of modern democracies.A presente pesquisa, através de uma metodologia teórica e comparativa, analisa o tema da legitimidade do direito, tendo em vista sua importância social e também política. Para abordagem da legitimidade do direito são investigadas e utilizadas as concepções de Max Weber e Jürgen Habermas, em razão das nuances trazidas pelos referidos autores a respeito do assunto. Assim, busca-se realizar um debate teórico entre os estudiosos, estabelecendo um paralelo entre as contribuições e deficiências possíveis de ambas as teorias para a temática da legitimidade do direito. Por fim, são realizadas algumas análises e reflexões sobre o tema, com respaldo nas contribuições de estudiosos sobre o assunto, averiguando-se, ainda, acerca da efetividade dos processos de validação discursiva no contexto das sociedades atuais e quais as limitações por elas enfrentadas no contexto das democracias modernas.FAPEMIG - Fundação de Amparo à Pesquisa do Estado de Minas Gerai
