Alisis Yuridis Perjanjian Franchise (Studi Kasus Wilayah Surakarta)

The objectives of this study are as follows: a) to determine the protection of the rights and obligations of the parties in the franchise agreement that involves; b) to find out the contents of the franchise agreement are in accordance with existing regulations. The approach method used in this research is the normative method. This type of research is descriptive. The results of the research obtained are that the franchise agreement based on the agreement of both parties can be extended with the terms and timeframe that will be determined then is the implementation of Article 4 of Government Regulation No. 42 of 2007 concerning Franchising states that Franchising is held based on a written agreement between the franchisor and the franchisee with due observance of Indonesian law. The obligation of the franchisor is to submit a license to the franchisee, while what is the right of the franchisor is the correct terms and criteria so that it can be classified as a feasible franchise and according to legal corridors. The settlement given by the xxx bakery franchise is carried out through deliberation and the court is a positive legal provision, namely law No. 30 of 1999 concerning Arbitration and Alternative Dispute Resolution.
