Analisis Yuridis Terhadap Hak Tanggungan Sebagai Jaminan Dalam Perjanjian Kredit Perspektif Uu Nomor 4 Tahun 1996 (Studi Pada KSP Mitra Mandiri Mojolaban)

This study examines the juridical analysis of security rights as collateral in the perspective of the credit agreement of Law No. 4 of 1996 on the Mitra Mandiri Savings and Loan Cooperative (KSP) and the form of a loan and loan agreement with guarantees of mortgage rights at the Mitra Mandiri Savings and Loan Cooperative (KSP), and Interpretation of the provisions of Article in Law Number 4 of 1996 concerning Mortgage Rights relating to the legal consequences if the debtor defaults. The results obtained from this study are the suitability of the credit agreement with the guarantee of mortgage with Law Number 4 of 1996 and the legal consequences for the parties who are bound by a credit agreement with a guarantee of Mortgage Rights at KSP Mitra Mandiri. Whereas the form of the debt acknowledgment agreement with guarantees of Mortgage Rights in the form of an underhand deed drawn up by the creditor, namely KSP Mitra Mandiri, is in accordance with Law Number 4 of 1996 concerning Mortgage Rights where after the agreement is approved the guarantee given is a Certificate of Land Ownership, which is then charged a power of attorney to impose mortgage rights (SKMHT) which was later upgraded to a Deed of Encumbrance (APHT) registered by the PPAT, which is in accordance with Article 11 of the Mortgage Rights Law. Then the land office issued a Certificate of Mortgage as proof of existence of Mortgage Rights, which has the same executorial power and has the same executorial power as a judge's decision having permanent legal force. Regarding the legal consequences for creditors and debtors if in default, it will be resolved on a family basis
