Legal maintenance of residential buildings and the role of the building engineering graduate = Mantenimiento legal en los edificios de uso residencial y el papel del graduado en edificación

All the regulations of our legal framework, starting with the generalist one, as the Civil Code, to the specific of the construction sector, as the LOE for example, require the owners and the users to maintain the buildings in a state of conservation that keeps out of risk the peo-ple who use it.A series of periodically programmed activities are deduced of the technical regulations set of the building systems, which form the Plan of Legal Preventive Maintenance of the Building. This Plan contemplates the intervention in the system parts wherethe fail-ures can cause important damages for the health of the users (elevators, boilers, etc.) or high economic impact injuries (façades, covers, etc). The real truth is that good maintenance practices implemented in buildings with other uses (industrial, hospital, public, etc.) are not transferred to residential buildings, despite forming the largest group of all of them.Several negative circumstances arise from the above considerations: deferred maintenance becomes corrective one with the high economic costs associated with the added values of urgency and opportunity, systems and materials life cycle reduction trigger the renewal; the owner’s liability to third parties’ damagesincreases and the insurance policy contracted not always covers all situations where exist a clear lack of functions.The role of the Building Engi-neering graduate must be fundamental in all the processes related to the building maintenance. The university education offers the knowledge in the characteristics of the materials and constructive systems, as well as the criteria of durability and the mechanisms through which pathological processes initiate. Therefore, it is able to interpret the injuries and damages that appear and toplan the neces-sary corrective actions. Making a comparison with medicine field, buildings need a doctor who recognizes their condition in the first in-stance and who knows to diagnose and cure if necessary, or to send to a specialist treating it. That "head technician" is thebuilding grad-uate. The importance of the sector for companies and technicians, its size, its practices and its development and expectations, deals with this communication. ----------RESUMEN---------- Del conjunto de normativa técnica de los sistemas que forman un edificio se desprende una serie de actividades programadas periódicamente, que forman el Plan de Mantenimiento Preventivo Legal del Edificio. Este Plan contempla la intervención en lossistemas en los que los fallos pueden provocar daños importantes para la salud de los usuarios (ascensores, calderas, etc.) o lesionesdeelevado impacto económico (fachadas, cubiertas, etc.). Lo cierto es que las buenas prácticas de mantenimiento implantadas en edificios de otros usos (industrial, hospitalario, de pública concurrencia, etc.) no se trasladan a la edificación residencial, a pesar de conformar el mayor grupo de todos. De lo anterior se desprenden varias circunstancias negativas: el mantenimiento diferido se transforma en correctivo, con los elevados costes económicos que conlleva por los valores agregados de urgencia y oportunidad; los sistemas y materiales disminuyen su ciclo de vida, precipitando su renovación; la responsabilidad de los propietarios frente a daños a terceros aumenta, y no siempre la póliza de seguro contratada contempla la cobertura de todas las situaciones en las que hay un manifiesta dejación de funciones. El papel del Graduado en Edificación debe ser fundamental en todos los procesos relacionados con el mantenimiento de los edificios. Por su formación conoce las características de los materiales y sistemas constructivos, así como los criterios de durabilidad y los mecanismos a través de los cuales se inician los procesos patológicos. Es capaz, por tanto, de interpretar las lesiones y daños que aparecen y de planificar las acciones correctoras necesarias. Buscando un símil con el campo de la medicina: los edificios necesitan un médicode cabecera que reconozca el estado de los mismos en una primera instancia y que sepa diagnosticar y curar llegado el caso, o bien,desviar el mismo hacia algún especialista que lo trate. Ese “técnico de cabecera” es el graduado en edificación.
