The protection of economic, social and cultural rights in armed conflicts: myth or reality?

Este trabajo versa sobre las dificultades que existen a la hora de garantizar los derechos humanos en un conflicto armado, especialmente, los derechos económicos sociales y culturales que ya de por sí son difíciles de garantizar en tiempo de paz. La reflexión parte del hecho que tradicionalmente se ha admitido que el Derecho Internacional Humanitario es el único Derecho aplicable a los conflictos armados, y, por tanto, con exclusión de los derechos humanos. Sin embargo, a raíz de varios pronunciamientos de la Corte Internacional de Justicia, se ha ido construyendo un consenso sobre la necesidad de protección de los derechos humanos incluso en los conflictos armados, en particular, los derechos civiles y políticos y los derechos económicos sociales y culturales. Precisamente, los derechos económicos sociales y culturales, por ser menos desarrollados que los primeros, suscitan la duda sobre cómo conviven con los derechos ya garantizados por el Derecho Internacional Humanitario, y si realmente pueden ser protegidos en su totalidad en un contexto de guerra, y de no ser posible, la medida en la que pueden al menos parcialmente ser garantizados en dicho contexto.This work analyses the difficulties in protecting human rights in armed conflicts, especially economic, social and cultural rights that are limited even during times of peace. The starting point for this study is the idea that international humanitarian law has been considered, traditionally, the only law applicable to armed conflicts to the exclusion of the international law of human rights. However, in recent years the International Court of Justice, through several advisory opinions, has helped forged broad consent on the necessity to protect human rights in the context of war, namely civil and political rights and economic, social and cultural rights. The key issue is how in actuality economic, social and cultural rights that are less developed than civil and political rights can coexist with international humanitarian law in the regulation of armed conflicts and whether they can be protected fully, or at least partially, within this context
