Personal Data Protection in the light of the Personal Data Protection Act of August 29 1997

This MA dissertation presents the problems connected with personal data protection in the light of Personal Data Protection Act of August 29 1997. International transference of personal data has become a widely spread phenomenon . The economic growth and the dynamization of country markets all over the world, especially on the level of IT systems led to the fact that a person's private sphere, part of which is personal data, becomes endangered. State administration stands in front of a great challenge due to the transfers of data and constant migration of societies that are characteristic to countries. The reality in which we live starts to make us realize that privacy is an extremely important value and that the right to protect it constitutes an unquestionable necessity and should be articulated explicite in legal acts. The coming into force of the Constitution of the Republic of Poland of April 2 1997 caused a breakthrough in the field of personal data protection.. The act of August 29 1997 on the protection of personal data is an implementation of the delegation of constitutional norms from Article 51 paragraph 5. The first chapter of this dissertation starts with an interpretation of the term "right to privacy" on the basis of comparing the views and statements by authors of works on the subject of "right to privacy" with judicial decisions by Constitutional Tribunal. Subsequently, the notion of "personal data" has been clarified. The Constitution determines precisely and in great detail the rights and freedoms of citizens of Poland and due to that the next chapter presents personal data protection in constitutional interpretation. A differentiation of personal data protection into protection in subjective and objective scopes is presented here. The Personal Data Protection Act of August 29 1997 regulates in a complete way the protections and methods of processing the data concerning private persons. The creation of this exceptional legal act was connected with the need to harmonize Polish law with European legislation, which has been commented on in the further part of the paper. Subsequently the subjective and objective scopes of the Personal Data Protection Act are presented. The discussed legal norms determine the area of application of the act, describe the dependences that arise from the contact with other legislation, both Polish and European legislative systems in relation to the discussed issues, as well as explain the aim of legislation introduced.The second chapter points to the legal foundations determining the requirements for personal data processing. Legal assumptions allowing processing of normal personal data and sensitive personal data with accordance to the law have been detailed separately. The latter are connected to the most personal spheres of one's life and due to that the legislator decided to subject them to unique protection. A definition of "personal data administrator" has been also given in this chapter.The third chapter has been devoted to personal data protection authority, that is the Inspector General for the Protection of Personal Data. At the beginning the need to exercise control in a country due to processing of personal data with accordance to the law has been justified. Subsequently the institution of the Inspector General for the Protection of Personal Data has been characterised as the office that is indispensable for a state of law and the main duties of the Inspector General for the Protection of Personal Data have been presented.Infringement of Personal Data Protection Act is associated with criminal liability, which is the subject of the fourth chapter of this paper. The Personal Data Protection Act provides several regulations that specify criminal liability for entities processing personal data contrary to the existing legal rules which is synonymous to the fact that the values protected by the act have particular importance for a human and a citizen.Praca magisterska prezentuje problematykę ochrony danych osobowych w świetle ustawy o ochronie danych osobowych z dnia 29 sierpnia 1997 r. Internacjonalny przepływ danych osobowych stanowi aktualnie zjawisko rozpowszechnione na szeroką skalę. Rozwój gospodarczy oraz dynamizacja rynków państwowych na całym świecie zwłaszcza na płaszczyźnie systemów informatycznych doprowadziły do tego, że sfera prywatności człowieka, na którą składają się jego dane osobowe staję się zagrożona. Administracja państwowa staje przed wielkim wyzwaniem ze względu na charakteryzujące państwo informacyjne transfery danych i stałe przemieszczanie się społeczności. Rzeczywistość, w której żyjemy zaczyna nas uświadamiać, iż prywatność jest wartością niezwykle cenną, zaś prawo do jej ochrony stanowi niezaprzeczalną konieczność i powinno być artykułowane explicite w aktach prawnych. Wejście w życie obecnie obowiązującej Konstytucji Rzeczypospolitej Polskiej z dnia 2 kwietnia 1997 r. niezaprzeczalnie wywołało przełom w dziedzinie ochrony danych osobowych. Wykonanie delegacji normy konstytucyjnej z art. 51 ust. 5 stanowi ustawa z dnia 29 sierpnia 1997 r. o ochronie danych osobowych.Pierwszy rozdział pracy magisterskiej został rozpoczęty od zinterpretowania terminu „prawa do prywatności” na zasadzie porównań poglądów oraz wypowiedzi autorów prac o tematyce przedmiotu „prawo do prywatności” wraz z orzecznictwem Trybunału Konstytucyjnego. Następnie wyjaśnione zostało pojęcie „danych osobowych”. Konstytucja w znacznej mierze w sposób rozbudowany i dokładny stanowi o prawach oraz wolnościach obywatela państwa polskiego, dlatego też w kolejnym rozdziale jest mowa o ochronie danych osobowych w ujęciu konstytucyjnym. Zostaje tu ukazane rozróżnienie ochrony danych osobowych na ochronę w aspekcie podmiotowym oraz w aspekcie przedmiotowym. Ustawa o ochronie danych osobowych z dnia 29 sierpnia 1997 r. w sposób kompletny normuje ochronę oraz metody przetwarzania informacji dotyczących osób fizycznych. Ustanowienie tego szczególnego aktu prawnego wiązało się z potrzebą harmonizacji prawa polskiego względem legislacji europejskiej, co zostało skomentowane w dalszej części pracy. Następnie jest mowa o przedmiotowym i podmiotowym zakresie ustawy o ochronie danych osobowych. Omawiane normy prawne wyznaczają obszar stosowania ustawy, opisują zależności jakie powstają przy styczności z innymi aktami prawnymi, zarówno polskiego jak i europejskiego systemu legislacyjnego w związku z omawianą problematyką, a także objaśniają cel wprowadzonych uregulowań.Rozdział drugi wskazuje podstawy prawne określające wymogi przetwarzania danych osobowych. Wyszczególnione zostały osobno przesłanki prawne zezwalające na zgodne z prawem przetwarzanie danych osobowych zwykłych oraz danych osobowych sensytywnych. Te ostatnie dotyczą najbardziej osobistych dziedzin z życia człowieka, dlatego też ustawodawca zdecydował się poddać je wyjątkowej ochronie. W tym rozdziale została także poddana wykładni definicja „administratora danych osobowych”.Rozdział trzeci jest poświęcony organowi ochrony danych osobowych to jest Generalnemu Inspektorowi Ochrony Danych Osobowych. Na początku uzasadniona została konieczność sprawowania kontroli w państwie ze względu na zgodne z regułami prawa przetwarzanie danych osobowych. Dalej scharakteryzowana została instytucja Generalnego Inspektora Ochrony Danych Osobowych jako urząd, który jest nieodzowny dla państwa prawa i przedstawione zostały zadania Generalnego Inspektora Ochrony Danych Osobowych.Naruszenie ustawy o ochronie danych osobowych wiąże sie z odpowiedzialnością karną, o czym traktuje ostatni, czwarty rozdział pracy. Ustawa o ochronie danych osobowych przewiduje szereg przepisów wyznaczających odpowiedzialność karną w stosunku do podmiotów przetwarzających dane osobowe niezgodnie z obowiązującym porządkiem prawnym, co jest jednoznaczne z tym, że wartości, których strzeże ustawa mają szczególne znaczenie dla człowieka i obywatela
