Judical arbitration as a competitive way for universal justice

Subject of my thesis is judical arbitration as a competitve way for universal justice. The arbitration is one way of the alternative dispute resolutions. The development of judical arbitration is response to the crisis of the traditional justice. The first chapter of this thesis is presentation history of arbitration. This institution derives from the times of Roman law. Arbitration has gained popularity in the Middle Ages and now is a very popular way of resolving disputes particulary in trade relations. The second chapter adresses most important concepts relating to arbitration. I defines the concept of arbitration, the arbitration agreement and its consequences and abitarability. The third chapter is about sources of arbitration law. I presnet The Geneve Protocol on arbitration clauses 1923, European Convention on International Commercial Arbitration 1961 and New York Convention on the Recognition and Enforcement of Foregin Arbitral Awards. Important sourses of arbitration law are also rules, particulary UNCITRAL Arbitration Rules adopted on 28 April 1976. The fourth chapter delas with the themes of arbitrators. I show the requirements to be met by the arbitrators. Impartability and Indepence are the two most desirable characteristics of an arbitrator.I also disuss the rights and duties of arbitrators. The last chapter is a charecteristic of arbitration. I presnet the main principles and characteristics of arbitration. I argue why you shoul use the institution of arbitration.Tematem mojej pracy jest sądownictwo arbitrażowe, jako konkurencyjny dla sądownictwa powszechnego sposób rozstrzygania sporów. Arbitraż jest jednym ze sposobów alternatywnego rozwiązywania sporów. Rozwój sądownictwa arbitrażowego jest odpowiedzią na kryzys tradycyjnego wymiaru sprawiedliwości. Pierwszy rozdział niniejszej pracy jest prezentacją historii arbitrażu. Instytucja ta wywodzi się z czasów prawa rzymskiego. Arbitraż zyskał popularność w Średniowieczu i obecnie jest popularnym sposobem rozwiązywania sporów szczególnie w stosunkach handlowych. Drugi rozdział dotyczy kluczowych pojęć związanych z arbitrażem. Definiuje w nim pojęcie arbitrażu, zapisu na sąd polubowny i jego konsekwencji, zdatności arbitrażowej. Trzeci rozdział jest poświęcony źródłom prawa arbitrażowego. Przedstawiam Protokół o klauzulach arbitrażowych, podpisany w Genewie w 1923 roku,Konwencję Europejską o międzynarodowym arbitrażu handlowym z 1961 r i Konwencję o uznawaniu i wykonywaniu zagranicznych orzeczeń arbitrażowych sporządzoną w Nowym Yorku w 1958r. Ważnym źródłem prawa arbitrażowego są także regulaminy, szczególnie Regulamin UNCITRAL przyjęty 28 kwietnia 1976 roku. Czwarty rozdział dotyczy tematyki arbitrów. Przedstawiam wymagania, które należy spełnić aby zostać arbitrem. Bezstronność i Niezależność to dwie najbardziej pożądane cechy u arbitrów. Prezentuje również prawa i obowiązki arbitrów. Ostatni rozdział jest charakterystyką postępowania arbitrażowego. Przedstawiam najważniejsze zasady i cechy postępowania przed sądami polubownymi.
