President and chancellor - status and relations through history of German regime

The title President and chancellor – status and relations through history of German regime clearly indicates that the point of the given work, is to present and clarify on how the changes on german political scene, with two world wars in the background, stimulated and influenced, the shaping of german state's political regime. Firstly, we are looking upon origins of the great change in german politics, the year 1918, which led to overthrowing the Kaiser and brought the institution of presi-dent, as a replacement. The totalitarian episode of The Third Reich and the rule of Adolf Hitler is, as a fact, not present throughout narration, due to the fact that as a whole, nazi rule was based on refuse of constitutionalism and legalism. The Fuhrer effectively liquidated the offices of chancellor and president on which we are focused. The narration ends with year 1969, the moment of breakthrough in the political history of West Germany and the ending point of the first phase in the history of reborn Germany. The 20 years that have passed since the empowerment of the Grund-gesetz were long enough to guarantee the strengthening of the new democratic order. Year 1969 left gemany first, with Heinrich Lübke ending his term as a president , and Kurt Georg Keisinger be-coming a new chancellor, the latter event having enormous political importance, marking creation of the Great Coalition of CDU/CSU together with SPD, proving the the high level of maturity among West German political establishment.Considering polish point of view, the organisation of executive branch, chancellor and presi-dent, is among most important issues. Of total four chapters, the first and the third, are the historical ones, aiming on sketching the political situation of Germany on the eve of first, and the second world war. The way those wars ended, affected political solutions used in Germany. Both chapters deal with depicting preparations and creations of new constitutional acts, frankly presenting basic characteristics of political regime under each constitution. The description excells at depicting what is the work's main focus, the executive branch, the chancellor and the president. Respectively, chapters second and fourth, use other approach to the topic, showing how actually relations between chancellors and presidents worked. This picture is not only limited to the analisys implied by the legal acts but as well, those originating from different political stances and personalities. Second chapter deals with those relations in the terms of Weimar Republic, fourth, in terms of West Germany. Although the rise of right- and left-wing authoritarian tendencies in Germany was, without a doubt, process of much importance, the work deals with it briefly, as there is no room available for it, and detailed description would exceed the limits of this study. The struggle of german economy, an important factor in Weimar history, lacks detailed description for the same matter, as the work focuses directly on events regarding president or chancellor and their bilateral relations.Third chapter does not focus on military actions between Third Reich and the Allies, only on political events that happened on brink of the Third Reich's collapse and were important for reshaping german politics after the war ended. For the same reason, the fourth chapter largely skips the topic of european integration as this matter is more the external factor and the work favors the internal ones.Temat przygotowywanej pracy magisterskiej to: Prezydent i kanclerz – status i relacje na tle historii ustroju Niemiec. W pracy prześledzimy wpływ wydarzeń politycznych u schyłku dwóch wielkich wojen światowych na rozwój i ukształtowanie ustroju państwa niemieckiego. Tok wywodu rozpoczyna się pod koniec 1918 roku, kiedy kończyła się I wojna światowa, a Niemcy weszły w nowy etap rozwoju. W miejsce dotychczasowego cesarza utworzono stanowisko prezydenta. Całkowicie zmieniło to ustrój tego państwa. Pomijamy okres antydemokratycznych rządów Adolfa Hitlera (1933-1945), gdyż w tym czasie nastąpiło zerwanie z wszelką tradycją konstytucyjną, a Hitler nazywając siebie Führerem de facto zlikwidował urząd prezydenta i kanclerza, a właśnie te dwa stanowiska stanowią oś pracy. Datą kończącą pracę jest rok 1969. Rok ten można uznać za zakończenie pierwszego etapu w historii Republiki Federalnej Niemiec. W ciągu dwudziestu lat od uchwalenia Ustawy Zasadniczej przyjęte w niej rozwiązania ustrojowe zdążyły się ukształtować i utrwalić. W tym roku kadencję zakończył prezydent Heinrich Lübke, a kadencję kanclerza Kurt Georg Kiesinger stojący na czele rządu tzw. wielkiej koalicji CDU/CSU i SPD. Okres rządów wielkiej koalicji świadczył o wysokim poziomie kultury politycznej w Niemczech. Wielka koalicja dowodziła dojrzałości niemieckich polityków gotowych do zawierania sojuszy w imię interesu ojczyzny, często wbrew politycznym poglądom. Było to potwierdzenie słuszności obranego kierunku i niepodważalności przyjętych w 1949 roku rozwiązań normatywnych.Z polskiego punktu widzenia interesujące są rozwiązania dotyczące uprawnień i relacji organów wchodzących w skład egzekutywy. I właśnie na dwóch organach państwowych tworzących władzę wykonawczą: prezydencie i kanclerzu stojącym na czele rządu skupi się praca. Praca podzielona jest na cztery rozdziały. Rozdział I i III są rozdziałami historycznymi, które mają nakreślać sytuację polityczną w Niemczech pod koniec I (rozdział I) i II (rozdział III) wojny światowej. Sposób zakończenia dwóch wojen światowych oraz decyzje podjęte bezpośrednio po zakończeniu działań wojennych wpłynęły na rozwiązania ustrojowe przyjęte w Niemczech. Następnie przejdziemy w obu rozdziałach do nakreślenia prac przygotowawczych oraz do uchwalenia konstytucji. Kolejny punkt to przedstawienie głównych założeń ustrojowych, podziału władz, ze szczególną uwagą poświęcimy miejsce na regulacje dotyczące władzy wykonawczej.Rozdział II i IV to z kolei analiza relacji politycznych między prezydentami a kanclerzami sprawującymi władzę w Republice Weimarskiej (rozdział II) i Republice Federalnej Niemiec (rozdział IV). W pracy podjęto próbę zreferowania nie tylko relacji relacjach ustrojowych stworzonych przez ustawodawcę, ale także tych politycznych wynikających z osobistych kontaktów i przynależności partyjnejW rozdziale drugim ze względu na objętość i temat pracy pomijamy szczegóły dotyczące wzrostu popularności nastrojów radykalnych, nacjonalistycznych i komunistycznych, które niewątpliwie wpłynęły na sytuację polityczną w Republice Weimarskiej. Niewiele miejsca poświęcamy także problemom gospodarczym, które trapiły Rzeszę w dwudziestoleciu międzywojennym. Omawiamy tylko te wydarzenia, które miały bezpośredni związek z pozycją urzędującego w danej chwili kanclerza lub prezydenta, bądź też wpłynęły na relacje między nimi. W trzecim rozdziale nie opisujemy wydarzeń wojennych, lecz skupiamy się na wydarzeniach, które nastąpiły pod koniec II wojny światowej i doprowadziły do ukształtowania ustroju państwa niemieckiego. Z kolei w rozdziale IV jedynie pobieżnie wspominamy o integracji europejskiej, ze względu na chęć skupienia uwagi na kwestiach wewnętrznych, a nie międzynarodowych
