The threat of corruption-causing regulations in terms of mechanism creating statutory standards in administrative law

The main purpose of this thesis is to answer the question if there are factors in the mechanism of creating statutory administrative law that could contribute to establishing corruption-causing regulations in this branch of law. The author started with presenting basic definitions and different approaches to the corruption phenomenon as well as mechanisms and sources of corruptive behavior in public administration. The special attention was paid to determining the quality of valid administrative law regulations relevant in this matter. Secondly, the subject of the research was overall legislative procedure with its objective and subjective determinants that refer directly to the nature of administrative law standards. As an empirical part of the study, the author presented several examples of corruption-causing regulations that occur within administrative branch of the law. For the purpose of this thesis, several bibliographic entries have been analyzed, which focused mainly on corruption and the science of administrative law. Moreover, author also drew from numerous law regulations on legislative procedure and corruption, relevant research reports and analyses that were prepared by government institutions and non-government research centers.Celem badawczym pracy jest uzyskanie odpowiedzi na pytanie czy w mechanizmie tworzenia prawa administracyjnego rangi ustawowej występują czynniki, które mogą mieć wpływ na powstawanie korupcjogennych regulacji tej gałęzi prawa. Autor przedstawił w pierwszej kolejności podstawowe definicje i ujęcia problematyki zjawiska korupcji oraz mechanizmy i źródła powstawania zachowań korupcyjnych w administracji publicznej, zwracając uwagę na wpływ jakości obowiązujących przepisów prawa administracyjnego w tym zakresie. Następnie przedmiotem badań objęto całość trybu ustawodawczego, ze szczególnym uwzględnieniem jego uwarunkowań podmiotowych oraz uwarunkowań przedmiotowych, odnoszących się bezpośrednio do charakteru norm prawa administracyjnego. W pracy przedstawiono i omówiono również wybrane przykłady korupcjogennych regulacji występujących w ramach tej gałęzi prawa.Na potrzeby tematu pracy przeanalizowano szereg pozycji naukowych z zakresu korupcji oraz nauki prawa administracyjnego, liczne regulacje prawne, dotyczące zarówno mechanizmu tworzenia prawa jak i tematyki korupcji, a także odnoszące się do przedmiotu badań, raporty i analizy, sporządzone w ramach prac instytucji rządowych oraz pozarządowych ośrodków badawczych
