Overtime work.

The subject matter of the presented thesis was the analysis of the regulations concerning overtime work. The knowledge of these regulations is essential for every employee in order to defend themselves effectively from- unfortunately - frequent infringement of their rights.The thesis consists of five chapters. In the first chapter the notion of labour time with regard to the labour code was described. The legal acts which regulate this subject matter and basic terms referring to the theme were presented. The regulations concerning overtime work from before the amendment in 2003 were also dealt with.The second chapter concerned the two premises in which overtime work is acceptable, namely an emergency operation and failure removal and special needs of an employer.In the next chapter, the description of both a duty and limitations concerning overtime work were presented.In the fourth chapter the rules of the payment for overtime work, the work of a part-time employee and the work of management were characterized. The elaboration was ended with the presentations of compensations due for overtime work.Przedmiotem pracy była analiza przepisów o pracy w godzinach nadliczbowych. Znajomość zagadnień z tego zakresu jest niezbędna dla każdego pracownika, aby mógł skutecznie bronić się przed – niestety - częstym łamaniem jego praw.Praca składa się z pięciu rozdziałów.W pierwszym rozdziale opisane zostało pojęcie czasu pracy w świetle przepisów kodeksu pracy. Przedstawiono akty prawne, które regulują tę tematykę oraz podstawowe pojęcia odnoszące się do tego zagadnienia. Opisano również przepisy odnoszące się do pracy nadliczbowej sprzed nowelizacji w 2003 roku.Drugi rozdział dotyczył dwóch przesłanek dopuszczalności pracy nadliczbowej jakimi są akcja ratownicza i usuwanie awarii oraz szczególne potrzeby pracodawcy. W kolejnym rozdziale zawarto opis zarówno obowiązku jak i ograniczeń dotyczących świadczenia pracy w godzinach nadliczbowych. W rozdziale czwartym scharakteryzowano zasady rozliczania pracy nadliczbowej, pracę zatrudnionego w niepełnym wymiarze czasu pracy oraz pracę kadry kierowniczej.Opracowanie to zakończono prezentacją rekompensat należnych za pracę w godzinach nadliczbowych
