Implementation of international mixed agreements by the European Union under the World Trade Organisation - TRIPS and GPA

This work has been devoted to the subject of international agreements, but contracts a bit more specific than the other mixed agreements.Peculiarity of this kind of international commitments is the simultaneity of the existence of a correlation between the parties in this case are also party to the European Union and the Member States.Linking these two entities associated with the existence of the division of responsibilities between them, and actually with some deficits on the side of the existing competence of the European Union. Undoubtedly, as practice shows, mixed agreements are becoming more common form of international commitment by the European Union. At the same time they constitute an integral part of EU law as they relate to the international laws, and so are also included in the sources of international law.In this paper, the issue of mixed agreements is presented largely in the light of European Union law, but also consider dimension of international law.The individual chapters make a sequence analysis in the context of international agreements (multilateral and plurilateral) concluded by the EU (Gen. 1), TRIPS Agreement and the Multilateral Agreement plurilateralnego GPA, which party is the EU and its Member States (rdz.2i rust. 3), as well as competence EU under the Treaty of Lisbon to the implementation of the aforementioned mixed agreements (TRIPs and GPA)Niniejsza praca została poświęcona tematyce umów międzynarodowy, ale umów nieco bardziej specyficznych niż pozostałe – umów mieszanych. Szczególność tego rodzaju zobowiązań międzynarodowych polega na istnieniu pewnej symultaniczności korelacji między jej stronami w tym wypadku stroną są równocześnie Unia Europejska i Państwa Członkowskie. Powiązanie tych dwóch podmiotów wiąże się z istnieniem rozdziału kompetencji między nimi, a właściwie z pewnych deficytem kompetencyjnym istniejącym po stronie Unii Europejskiej . Niewątpliwie jak pokazuje praktyka umowy mieszane stanowią coraz częstsza formę zaciągania zobowiązań międzynarodowych przez Unię Europejską. Przy czym stanowią one integralną część prawa UE jak też dotyczą ich międzynarodowe regulacje prawne, tak więc są również zaliczane do źródeł prawa międzynarodowego. W niniejszej pracy problematyka umów mieszanych została przedstawiona w głównej mierze w świetle prawa Unii Europejskiej, jednak został także uwzględniony wymiar prawa międzynarodowego.W poszczególnych rozdziałach dokonam kolejno analizy w kontekście umów międzynarodowych( multilateralnych i plurilateralnych) zawieranych przez UE ( rdz. 1), wielostronnego Porozumienia TRIPS i plurilateralnego Porozumienia GPA którego stroną jest UE i Państwa Członkowskie (rdz.2i rdz. 3), a także kompetencji UE na podstawie Traktatu z Lizbony do wykonywania wyżej wymienionych umów mieszanych (TRIPS i GPA)
