Posting of workers and collective labour law in the EU : there and back again : between internal market and fundamental rights

The interest for the phenomenon of posting of workers in the EU has been revived by the (infamous) decisions delivered by the CJEU in the Laval (2007), Rüffert (2008) and Commission v. Luxembourg (2008) cases. This research explores the relationship between the posting phenomenon and collective labour law. In particular, it examines the potential impact on national systems of collective labour law of the legal construction of this phenomenon at the EU level. The analysis identifies two main tensions entailed by recent developments both legal and at socio-economic. On the one hand, the growing tension between the case law of the CJEU about the relationship between fundamental freedoms of the internal market and fundamental social rights, and the level of protection awarded to these same rights by international bodies. On the other hand, the trend towards de-centralisation of collective bargaining, which appears to collide with the marked "preference" of the Court of Justice for centralised systems when it comes to extending working conditions to posted workers.Depuis les arrêts Laval (2007), Commission c. Luxembourg(2008) et Rüffert (2008) rendus par la Cour de Justice de l’Union Européenne, on constate un intérêt renouvelé pour le phénomène du détachement de travailleurs dans le contexte d’une prestation de services transnationale. La recherche se concentre sur le thème du rapport entre ces travailleurs détaches et le droit des relations collectives. Le projet vise notamment à analyser l’impact potentiel de ce phénomène sur les systèmes des relations collectives existantes. Cette analyse permet d'identifier deux tensions principales entraînées par les évolutions récentes au niveau légal et socio-économique. En premier lieu, la tension croissante entre la jurisprudence de la CJUE dans le domaine de la relation entre droits sociaux fondamentaux et libertés fondamentales du marché intérieur et la protection accordé à ces droits par certains organes internationaux. En deuxième lieu, la tendance vers des systèmes décentralisés de négociation collective qui semble aller à l'encontre de la "préférence" de la Cour de Justice pour des systèmes centralisés quand il s'agit d'évaluer l'extension des conditions de travail au travailleurs détachés.(DROI - Sciences juridiques) -- UCL, 201
