Electronic securities: a reality as palpable as it is disturbing in the Colombian legal system

Mediante el presente documento se propone demostrar que el ordenamiento jurídico colombiano reconoce la existencia de títulos valores electrónicos, toda vez que cuentan con la misma naturaleza jurídica que los títulos valores en papel, siendo aplicables los principios tradicionales de esta institución jurídica. Pese a lo anterior, existen vacíos normativos que han dificultado su desarrollo e implementación en la práctica, siendo necesario contar con reglas que permitan su adecuada utilización.Through this document it is proposed to demonstrate that the Colombian legal system recognizes the existence of electronic securities, since they have the same legal nature as paper securities, the traditional principles of this legal institution being applicable. Despite the above, there are regulatory gaps that have hindered its development and implementation in practice, and it is necessary to have rules that allow its proper use
